1. Acceptance of Terms
By accessing or using Gifted Monitor (the "Service"), you agree to these Terms and Conditions and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
Gifted Monitor provides automated website uptime monitoring, response time tracking, and WhatsApp alert notifications when monitored sites change status. The Service is provided by Gifted Tech.
3. Account Registration
- You must provide accurate, complete information when creating an account
- You must verify your WhatsApp number during sign-up via OTP
- You are responsible for maintaining the security of your password
- You must not share your account credentials with others
- You must be at least 13 years old to use the Service
4. Acceptable Use
You agree not to use the Service to:
- Monitor websites without authorization from the site owner
- Conduct denial-of-service attacks or overload servers with excessive pings
- Attempt to reverse-engineer, exploit, or compromise the monitoring infrastructure
- Submit false or misleading information
- Use the Service for any unlawful purpose
- Create accounts using automated means or bots
5. Monitor Limits & Fair Use
We reserve the right to impose reasonable limits on the number of monitors, check frequency, and storage per account to ensure fair usage and service stability for all users. These limits may be adjusted from time to time.
6. WhatsApp Alerts
By using the notification feature, you consent to receive automated WhatsApp messages from Gifted Monitor. Alert delivery depends on WhatsApp API availability and is not guaranteed 100% of the time. We are not liable for missed alerts due to third-party service outages.
7. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. Monitoring checks may be delayed or missed during planned maintenance or unexpected outages. We are not liable for losses resulting from service interruptions.
8. Data & Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated by reference into these Terms.
9. Intellectual Property
The Service, including its code, design, branding, and content, is owned by Gifted Tech. You may not copy, modify, distribute, or create derivative works without written permission.
10. Account Termination
You may delete your account at any time from the Profile settings page. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice. Upon termination, your data will be deleted in accordance with our Privacy Policy.
11. Limitation of Liability
To the fullest extent permitted by law, Gifted Tech and Gifted Monitor shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be error-free, uninterrupted, or free of harmful components.
13. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by updating the date at the top of this page. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Kenya.
